St. Augustines Petty Sessions

St. Augustine's Petty Sessions - Saturday. (Before Wm. Delmar, Esq., T. G. Peckham, Esq., and Peter Marten, Esq.)

Herne: Allowing a Horse and a Donkey to Stray on the Highway.

Gilderoy Scamp, a licensed hawker who travels with a van, was charged with allowing his horse and donkey to stray on a highway, leading from Eddington to Broomfield, on the 16th November. Mr Philips appeared for the defendant.

Police Sergeant Gower deposed that on the day in question he was passing through Pigeon-lane, leading from Eddington to Broomfield, when he saw a horse grazing with its fore legs tied with a halter to prevent it getting far away. There was a donkey laid down in the lane, no one was watching them; but a little further up the lane he saw the defendant's van drawn into an orchard, and the defendant and his son were there.

Mr. Philips said the defence was that Scamp had permission to turn his horse and donkey into the orchard, and that they had strayed into the lane without his knowing through a break in the hedge.

The Magistrates considered the offence proved and fined the defendant 2s. and 11s. 6d. costs.
